1. Preamble:
The company of NAM system (hereinafter the Producer) manufactures and develops GPS devices for online monitoring of locations. These devices can be bought on the e-shop of the Producer – malagps.cz. In the future these terms and conditions will be governed by the provisions in the law covering consumer protection.
2. Definitions:
Mobile application Mala GPS – freely available application for mobile telephones (Android and iOS).
E-shop – E-shop of the Producer at the address malagps.cz.
Tracker – GPS monitoring device for designating locations.
3. Scope of the Terms and conditions:
The Terms and conditions relate to the usage of MALA GPS trackers and the Mala GPS mobile application. These conditions are binding and valid for both contractual parties.
The Customer accepts these conditions and also accepts the principles of personal data protection.
4. Customer registration:
In order to use the GPS tracker, it is necessary for the Customer to register on the mobile application. On this registration, the Customer will state their name, surname, e-mail and billing information. The Customer must state true information.
For the tracker to work correctly, the Customer must choose a profile and operational mode, which can be changed at any time.
It is necessary to pay a subscription fee for services used on the application in order for it to operate. The Customer chooses the frequency for payments (monthly or yearly) and the method of payment. Subscriptions for using the mobile application can only be paid via the mobile application in the form of recurring payments.
By buying the subscription, the Customer expresses their agreement to the immediate initiation of the provision of tracker services. The Customer will be charged periodically for the use of the services according to the method of payment saved. The Customer can cancel payment at any time directly via the application and without giving any reason for this. If the Customer only uses services for part of the month or year, no right to the return of payment or other compensation for the unused period of time will arise because of the cancellation of the subscription.
5. Regulations for correct use:
In order to ensure the fully functional usage of the tracker, it is necessary to always have the most recent version of the mobile application downloaded. The Customer can find information about mobile application updates at Google Play or AppStore.
Login data chosen by the Customer are confidential and so should not be given to a third party in order to protect against the abuse of this data.
6. Prices:
Prices for services used in the application are stated including VAT.
Current prices for services are stated directly in the Application and these are paid exclusively via the Application.
Payment for application services can be cancelled by the Customer at any time directly via the application and without needing to give a reason for this.
If the Customer cancels their subscription, the periodic payment of subscriptions will be cancelled and Application services will also be cancelled. After cancelling the subscription, the Customer will not have access to Application functions or to data.
7. Responsibility and warranty:
The Provider cannot guarantee continuous accessibility especially in situations where there is an outage caused by maintenance, updating or during problems with network coverage of the operator. The Customer confirms that they will not claim any damage compensation.
The Provider guarantees, that the tracker will function for 24 months from the date of purchase. If, during this period, a fault appears in the tracker, the Customer should send the tracker to the address of the Producer who will ensure the repair or, if necessary, the replacement of the tracker.
The Customer is responsible for the correct usage of the tracker. The Provider bears no responsibility for damage or data leaks that occur as the result of incorrect usage of the tracker.
