Principles of processing and protection of personal data
Your personal data is safe with us.
Protecting your personal data has always been and always will be our top priority. We only process personal data as necessary and only for as long as necessary. Please familiarise yourself with what data we process, why we process it and how we protect it. Below you will find the principles by which we care for and handle your contacts in relation to GDPR (General Data Protection Regulation).
The processing of personal data is governed in particular by Regulation (EU) 2016/679 of the European Parliament and of the EU Council dated April 27th 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) ("GDPR")
- Who is the administrator?
We are the company of NAM system, a.s., with its headquarters at U Pošty 1163/13, Havířov – Prostřední Suchá, 735 64, ID number : 25862731, registered in the Commercial Register administrated by the Regional Court in Ostrava, Section B, Entry 2365
In relation to your personal data, we hold the position of administrator: we determine how personal data will be processed, for what purpose, for how long and, where necessary, we select other providers who will assist us with the processing of this data.

- How do we process personal data and why?
We process personal data that you entrust to us for the following reasons (to fulfil these purposes):
Provision of services, contractual performance, organizing webinars, training
- Name and surname,
- e-mail address
- telephone number
- postal address
- billing/invoicing data (name of company, ID number, VAT number, bank account number)
- information on the use of products and services
- geolocation data
- information from records of phone calls or other communications with you
- other data, if applicable, in connection with services provided
We need personal address and billing data for the purpose of contractual performance.
We use product usage information to recommend appropriate user solutions.
If you register for one of our webinars, we will need your email address in order to organise participation in the webinar.
With your prior consent, we may process recordings of telephone calls made to our customer service line. If you do not wish to be recorded, you can use other communication channels.
Account management
If you are our customer, we need your personal data (billing data) in order to comply with our legal obligations to issue and register tax documents.
Marketing – sending of personalised communications (authorised interest / consent)
We use your personal data (email, name, phone), gender, what links/information you open in emails and when you open these links most often, for the purpose of direct marketing - sending commercial communications to you. We do not want to send you marketing materials that are of no interest to you. That's why we monitor whether you're interested in our emails and try to tailor the content of these emails to your interests according to what you open in emails sent to you.
If you are our customer, we view it as in our legitimate interests to send you these tailored newsletters for a maximum of 5 years from your last order.
If you receive free training from us (via e-books, webinars or webinar recordings) or sign up for newsletters on our blog, we will send you our newsletters on the basis of your consent and for a period of 5 years from the date of this consent.
Either way, every e-mail you receive will allow you the option to opt out of receiving newsletters.
Advanced consent-based marketing
With your prior consent only, we may also send you inspirational offers from third parties or use your email address for example for remarketing and targeting of Facebook advertising, in these cases for a maximum of 3 years from the date of consent. This can of course be revoked at any time via our contact links.
We will retain your personal data for the duration of the limitation period unless the law has provided a longer retention period or we have specified otherwise in specific cases.
Photography
On the basis of your consent, we may publish photographs from sales events and photographs, videos, etc. sent by you showing the usage of the products that you purchased on our e-shop malagps.cz.
We use photographs in promotional materials, especially on our website, Facebook profile and Instagram.
We will process your personal data for the duration of personal data processing.
We will retain your personal data for the duration of the limitation period, unless the law has provided a longer retention period or we have specified otherwise in specific cases.
- Transfer of personal data to 3rd parties
Our employees and associates have access to your personal data and they have been trained in the security of personal data processing.
We use the services and applications of providers who specialize in specific processing and who comply with GDPR to provide partial processing operations that we cannot provide on our own.
These are the providers of the following platforms and services:
SmartSelling a.s. (communication application)
Transport company PPL
Heuréka (satisfaction questionnaires)
Furthermore, we use the services of Google Analytics and, with your consent, Facebook pixel for targeted advertisements.
It is possible that we may decide to use other applications or providers in the future to facilitate and improve the quality of processing. However, we promise that in such cases we will place at least the same demands on the provider in terms of security and quality of processing as we place on ourselves.
- Cookies
Cookies are text files containing small amounts of information that are downloaded to your device when you visit our website. Cookies are then sent back to the website or to other websites that recognise them on each subsequent visit.
Cookies perform a variety of tasks, such as enabling you to navigate between websites efficiently, remembering your preferences and generally improving the user experience. They can also ensure that the advertisements displayed online are better tailored to your personality and interests.
We use the following cookies on our websites:
- Necessary cookies: these are required for the operation of the website, for example, to allow you to log into secure areas of the site and for other basic functionality of the site. This category of cookies cannot be disabled.

Facebook Pixel services, operated by the company of Facebook Inc., headquarters: 1601 Willow Road, Menlo Park, CA 94025, USA. The cookies collected are subsequently used by the company of Facebook Inc. in accordance with Zásadami ochrany soukromí.
- Security and protection of personal data
We protect personal data to the maximum extent possible by using start of the art modern technologies. We have adopted and maintain all possible (currently known) technical and organisational measures to prevent the misuse, damage or destruction of your personal data.
- Data transmission outside of the European Union
We only process data in the European Union or in countries that provide an adequate level of protection on the basis of decisions made by the European Commission.

You have the right to information, which is already supplied by this information page which includes the personal data processing policy.
Thanks to the right of access, you can request us, at any time, to document, within a period of 30 days, which of your personal data we process and why.
You can exercise your right to restrict processing if you believe that we are processing your data inaccurately, if you believe that we are processing wrongfully but do not want to delete all of your data, or if you have objected to this processing. You can limit the scope of personal data or the purposes for which this is processed. (for example, by unsubscribing from the newsletter you limit data processing for sending commercial communications.)
Right to object
If you believe that we are processing personal data wrongfully.
Right of transferability
If you would like to take your personal information and transfer it to someone else, we will follow the same process as when you exercise your right of access - except that we will supply the information to you in computer-readable form. We reserve a period of 30 days to do this.
Right to deletion (be disregarded)
A further right that you have got is the right to deletion (to be disregarded). We don't want to disregard you, but if you wish, you have the right for this to be done. In this case, we will delete all your personal data from our system and from the system of all sub-providers and backups. We will need 30 days to secure the right to deletion.
In some cases, we are bound by legal obligations, e.g. we have to keep records of tax documents issued for a period set by law. In this case, we will therefore delete all such personal data that is not bound by other laws. We will inform you of the completion of the deletion by e-mail.
Complaint to the Office for Personal Data Protection
If you feel that we are not treating your data in accordance with the law, you have the right to complain to the Data Protection Authority at any time. We would be very pleased if you would first inform us of any suspicions of this nature so that we can do something about it and rectify any wrongdoing.
To unsubscribe from newsletters and commercial communications
If you are a customer or if you have received free training from us, we will send you emails with inspirational ideas, articles or products and services, based on our legitimate interest. You can unsubscribe via the unsubscribe link in each email.
In other cases (e.g. signing up for our newsletter), we will only send these to you on the basis of your consent. You can stop receiving our emails at any time by clicking on the unsubscribe link in each email sent.
We provide all communications and statements regarding the rights you have exercised free of charge. However, if the request is clearly unfounded or unreasonable, in particular because it is a recurring request, we are entitled to charge a reasonable fee taking into account the administrative costs involved in providing the information requested.
- Confidentiality
We would like to assure you that our employees and associates who will process your personal data are obliged to maintain confidentiality of personal data and security measures, the disclosure of which would compromise the security of your personal data.
These principles of processing are effective from 01.12.2022.
